Registered NGOs must file annual returns including audited financial statements and activity reports. The registration process typically takes 3 to 6 months.
Registering a Community-Based Organization (CBO)
CBOs are grassroots organizations formed by communities to address local needs and challenges. CBO registration is devolved to the county level and is managed by the county Department of Social Development (also known as the Department of Gender, Culture, and Social Services). Once approved, a registration certificate is issued. CBOs must maintain proper records, hold regular meetings, file annual reports with the county office, and conduct annual elections as specified in their constitution. CBO registration is simpler and faster than NGO registration, typically taking 2 to 4 weeks.
Tax Exemption and Compliance for Non-Profits
Registered non-profit organizations in Kenya can apply for tax exemption from KRA. To qualify for tax exemption, the organization must demonstrate that it is established solely for charitable, educational, or public benefit purposes, and that no part of its income or assets is distributed to its members or directors. The application is made to the Commissioner General of KRA with supporting documents including the registration certificate and constitution.
